I. TERMS AND CONDITIONS

1. Scope of Services

The Provider mainly provides:

  • product graphic design

  • packaging and label design

  • preparation of graphic and production-ready files

  • technical layout processing of texts

  • visual marketing materials

The Provider does not provide:

  • legal services

  • regulatory consulting

  • medical or pharmaceutical evaluation

  • medical device or pharmaceutical product registration services

2. Establishment of Cooperation

Cooperation is established by quotation approval, order confirmation, or payment of an advance invoice.

3. Scope of Liability

The Provider is responsible for professional graphic and technical processing of materials based on documents and information supplied by the Client.

The Provider is not responsible for the content, legal, regulatory, or medical accuracy of materials supplied by the Client, nor for the legal or regulatory compliance of the final product.

In accordance with European Union legislation, responsibility for compliance of a product with legal and regulatory requirements lies with the entity placing the product on the market, in particular the manufacturer, importer, or brand owner.

For this reason, the Provider is not responsible in particular for:

  • legal or regulatory compliance of the product

  • health or marketing claims

  • product composition

  • product classification

  • correctness or entitlement to use CE marking

  • UDI, MDR, IVDR, or any other regulatory obligation

  • product registration or notification

  • approval of the product by regulatory authorities

  • product quality, safety, or effectiveness

The Provider does not provide legal, regulatory, medical, or pharmaceutical consulting.

The Client is responsible for ensuring professional review of final materials before production and market placement.

The Client bears full legal responsibility for the product placed on the market, including its regulatory compliance, safety, and accuracy of information provided on the product and in accompanying documentation.

4. Responsibility for Texts and Regulatory Information

The Client is responsible for providing:

  • final texts

  • IFU / instructions for use

  • claims and marketing statements

  • regulatory markings and mandatory information

The Provider is not responsible for the content or legal accuracy of such information.

5. Final Production Approval

The Client is responsible for reviewing and approving final materials before production.

After approval by the Client, the Provider is not responsible for:

  • printing

  • manufacturing

  • distribution

  • use of graphics by third parties

6. Third Parties

The Provider is not responsible for actions of:

  • manufacturers

  • printing houses

  • distributors

  • import partners

7. Copyright

Copyright is transferred to the Client after full payment.

The Provider reserves the right to use outputs in portfolio unless otherwise agreed.

8. Payment Terms

In case of payment delay, the Provider may:

  • suspend work

  • withhold deliverables

  • terminate cooperation

9. Limitation of Liability

The Provider's maximum liability is limited to the amount paid for the specific project.

The Provider is not liable for loss of profit, consequential damages, or indirect damages.

10. Governing Law

All legal relationships are governed by the laws of the Slovak Republic.
